REGULATION FOR THE USE OF THE COMPANY VOLUNTEER PORTAL

Accepting the terms and conditions of the REGULATION FOR THE USE OF THE VOLUNTEER PORTAL, is an essential condition for the USER to have access and to use the VOLUNTEER PORTAL.

By accepting, the USER will agree to all terms and conditions in the REGULATION FOR THE USE OF THE VOLUNTEER PORTAL, without restrictions and/or caveats of any kind.

On the Purpose of the VOLUNTEER PORTAL

The VOLUNTEER PORTAL aims to gather and integrate diverse USERS that have the common objective of implementing social and philanthropic projects and to work on volunteer actions, without pay, without entailing any employment relationship, nor any labor or social security obligations, in accordance with Law No. 9.608 of February 18, 1998.

The VOLUNTEER PORTAL functions as a platform for communication among its USERS so as to allow:


1.dissemination of various social actions;
2.presentation of volunteering opportunities in social actions;
3.dissemination of actions that have been implemented and/or are undergoing implementation.

On the USER

The VOLUNTEER PORTAL is destined to be used by individuals and corporate entities that intend to implement social and philanthropic projects and work in volunteer actions.

In the case of corporate entities, the company will have exclusive responsibility to name one or more people that will have access to the VOLUNTEER PORTAL. These people will be designated as USERSS, linked to the company they represent.

In the case of individuals, minors under the age of 16 may use the VOLUNTEER PORTAL as long as they are authorized in writing by both parents or guardians.

The VOLUNTEER PORTAL reserves the right to prevent, restrict, or deny access and use of the Portal to any individuals or legal entities, even if they have already registered as users in the VOLUNTEER PORTAL.

On the Use of the VOLUNTEER PORTAL

The VOLUNTEER PORTAL is destined for exclusive use of the USERS registered on the VOLUNTEER PORTAL.

The use of the VOLUNTEER PORTAL is aimed at specific purposes established in the clause On the Purpose of this REGULATION OF USE OF THE VOLUNTEER PORTAL. Any activity that is not in accordance to the present regulation is prohibited.

The use of the VOLUNTEER PORTAL on the part of the USERS is conditioned to the completion of the USER registration at the VOLUNTEER PORTAL. The USER data will be treated in accordance to the conditions established in the clause On the USER registration and Privacy Policy bellow.

On the USER registration and Privacy Policy

To use the VOLUNTEER PORTAL the USER must correctly fill in the registration form. The USER is responsible for maintaining the data updated.

USER data collected by the VOLUNTEER PORTAL will be used solely by the VOLUNTEER PORTAL, especially with the purpose of developing and improving the VOLUNTEER PORTAL services.

The VOLUNTEER PORTAL will not publicize, grant, or trade, at any time and title, the personal data of USERS in the registration base.

Notwithstanding, the VOLUNTEER PORTAL may publicize, at any moment and at any title, all USER actions present in open areas and/or areas for exclusive use by USERS.

Given a judicial order, the VOLUNTEER PORTAL will provide all registered information related to the USER within the limits of the abovementioned determination.

The VOLUNTEER PORTAL reserves the right to use the USER registration data for composing the profile of USERS of the VOLUNTEER PORTAL, which may be disseminated by the VOLUNTEER PORTAL.

On the Norms of Conduct

The USER is expressly prohibited from using the VOLUNTEER PORTAL for any activity, even if legal, that conflicts with the Norms of Use for the VOLUNTEER PORTAL, in addition to the following activities:


1.dissemination and offering, free of charge or charging, goods and services of any nature;
2.use of foul language in any area in the VOLUNTEER PORTAL;
3.practice, dissemination, and incentive of illegal activities of any sort, be they civil or criminal;
4.disrespect of public order, morale, and adequate behavior;
5.invasion of privacy of other USERS;
6.use of name and/or identification that belongs to other than the USER him/herself;
7.disturbance of order at the VOLUNTEER PORTAL and among its USERS;

The USER is obligated to not allow third parties to use his/her access to the VOLUNTEER PORTAL, under penalty of responding for any damages resulting from the non-compliance with the present prohibition.

If the USER becomes aware of undue use of his/her data with the purpose of accessing the VOLUNTEER PORTAL said fact must be communicated immediately to the VOLUNTEER PORTAL administrator in writing by e-mail so that the necessary measures might be taken to prevent the unauthorized use of USER data and of the VOLUNTEER PORTAL.

The USER is expressly prohibited of having more than one registration in the VOLUNTEER PORTAL. As such, each USER will be individually identified and will have unique and exclusive access data.

When using texts, photos, and other work by third parties the USER must obtain the necessary licenses for use of said work and, additionally, the authorizations for use of image of third parties.

Any violation of copyright belonging to third parties will be of the full responsibility of the USER, who is also subjected to the conditions in the clause On the Intellectual Property.

On the Intellectual Property

The names, commercial names, brands, logos, designs, photos, visual identity, software files, along with any other objects made available electronically at the VOLUNTEER PORTAL, be they or not accessible to USERS, belong to the VOLUNTEER PORTAL and/or third parties, and are subjected to the Brazilian norms related to intellectual property.

USERS are expressly forbidden of using property, of an intellectual origin, of third parties, at any time and title, except by prior and express authorization, in writing, by the VOLUNTEER PORTAL, its USERS, partners, or third party holders of said properties.

The use of the abovementioned properties without due authorization of their holders will configure a violation of intellectual property rights. The offender will be subjected to the civil and criminal penalties applicable and foreseen in the specific legislation on the matter.

The USER is obligated to maintain the VOLUNTEER PORTAL exempt of any responsibility in the violation of intellectual property rights resulting from action or omission on the part of the USER, in accordance with the terms of the clause On the Responsibility Caveats.

On the Responsibility Caveats

The USER is obligated to maintain the VOLUNTEER PORTAL, its maintaining entities, associates, directors, employees and third parties free of any and all responsibility relative to any damages or prejudice evidently caused directly and/or indirectly by the USER, including in reference to lawyer fees, legal costs, damages, and compensations of any nature, at any time and title.

The USER will answer to the illegal acts, be it civil and/or criminal, practiced, by action or omission, at the VOLUNTEER PORTAL, incurring in the above provision.

On the Disconnection of the USER

The VOLUNTEER PORTAL reserves the right to cancel the registration and access of the USER to the VOLUNTEER PORTAL fully and/or partially, at any given time, without needing to provide prior notice to the USER and/or any justification to do so.

The inobservance of any provision in the REGULATION OF USE OF THE VOLUNTEER PORTAL will lead to immediate disconnection of the USER and, consequently, the prevention of access to the VOLUNTEER PORTAL.

Notwithstanding, the USER may request the VOLUNTEER PORTAL to reconsider its decision of disconnection.

Any possible violation of the provisions on the REGULATION OF USE OF THE VOLUNTEER PORTAL may be resolved by the USER. The USER may instruct his/her request for reconsideration of disconnection with the proof of resolution of anything pending or violation.

The VOLUNTEER PORTAL will decide, at its exclusive discretion, on the definitive cancellation of access of the USER to the VOLUNTEER PORTAL or, on the other hand, readmission.

The decision to readmit the USER to the VOLUNTEER PORTAL will represent mere act of liberality on the part of the VOLUNTEER PORTAL and will not represent, under any circumstance, any alteration in the terms and conditions of the REGULATION OF USE OF THE VOLUNTEER PORTAL.

Likewise, the readmission of the USER will not represent an agreement of the VOLUNTEER PORTAL with the action or omission that led to the disconnection of the USER. The USER will remain with the obligations foreseen in the REGULATION OF USE OF THE VOLUNTEER PORTAL, notably in reference to the responsibilities and consequences of illicit activity. The USER is subjected to the penalties and responsibilities foreseen in the REGULATION OF USE OF THE VOLUNTEER PORTAL, including, without limitation, in the clause On the Disclaimer of Liability.

On Closing the operations of the VOLUNTEER PORTAL

The definitive and/or temporary closing of the VOLUNTEER PORTAL activities will not result in any obligation with the USER, including in reference to prior notice of said fact, compensation, payment and/or damages at any time and title.

On the Applicable legislation and Court

The present REGULATION OF USE OF THE VOLUNTEER PORTAL, the use of the VOLUNTEER PORTAL, and the relations between the USER and the VOLUNTEER PORTAL are subjected to the Brazilian legislation in effect.

The USER agrees in selecting, along with the VOLUNTEER PORTAL, the Court from the County in the Capital of the State of São Paulo as the only competent court to address any doubts and/or disputes originated from this REGULATION OF USE OF THE VOLUNTEER PORTAL and including the use of the VOLUNTEER PORTAL, expressly renouncing any other court, no matter how privileged.
